If we are worried about the Type I errors and minimize them, we increase the number of Type II errors. Thus, I want to reemphasize this issue of unavoidability. If we focus on the unavoidable, we may recognize that the issues are harder than we thought they were. But as I have said, academics ought not try to avoid the hard issues. Rather, I want people to be as hard on their own ideas as they can be. Now, finally, if we think of the rights of both sides of the issue in rightsbased terms, we may arrive at a different picture of rights.

It is inconsistent with an honest search for knowledge to brook no criticism; to fail to conduct classes so that students feel free to say that they wonder why the curriculum does not include something or that they would prefer to be addressed in one manner rather than another. ”8 Academic freedom is the freedom to participate without fear in that discourse. The obligations to teach and conduct research in the university are requirements to participate in that discourse. These obligations are to engage in rational debate with one’s colleagues engaged in research and with one’s students in the classroom.

This fact means not only that legitimate grievances may be overlooked or trivialized but also that trivial grievances may be taken very seriously and waste a great deal of time. With more experience, a sense of judgment and confidence in dealing with these matters develops. What’s at Stake? My next point concerns the reshaping of concepts. As a result of the statement of new norms of equality, a reshaping of concepts is under way in many public and private institutions. Examples are the concept of the family and the concept of liberty.
